Legal Notice – Water Quality Certification

Pursuant to 33 U.S.C. 1341 and M.G.L. c. 21 §§ 26 - 53, notice is given of a 401 Water Quality Certification application for dredging of sediment material within five ponds used by the Harvard Fire Department (HFD) as water sources in emergency situations. The five ponds are located on Poor Farm Road, 3 Cliffside Drive and 4 Granite View Lane, Sholan Circle and 11 Sholan Circle, Scott Road, and Stow Road in Harvard, Massachusetts. Subsequent disposal of dredged material will occur on a Town-owned upland area on Stow Road.

The Applicant is the Town of Harvard, 13 Ayer Road, Harvard, MA 01451. Landowners include the Town of Harvard (Poor Farm Road and Scott Road), Amith Nair and Yamini Gopalakrishnan (3 Cliffside Drive), Gregory and Melissa Schneider (4 Granite View Lane), High Meadow Farm Property Owners Association (Sholan Circle), Thomas and Ellen McCabe (11 Sholan Circle), and Pine Hill Condominium Trust (Stow Road).

Written comments should be sent to Massachusetts Department of Environmental Protection, 401 Dredging Program, 100 Cambridge Street, Boston, MA 02114 or by email to david.w.wong@mass.gov within twenty-one days of this notice. Any group of ten persons, any aggrieved person, or any governmental body or private organization with a mandate to protect the environment who submits written comments may appeal the Department’s Certification. Failure to submit comments before the end of the public comment period may result in the waiver of any right to an adjudicatory hearing.
